Birmingham Land Bank Authority Programming is geared toward creating partnerships.

The BLBA and City of Birmingham is extinguishing municipal liens and assessments and expending staff time and resources with the understanding that the purchaser will maintain and develop the property and pay taxes on it. Strong consideration will be given to applicants whose stated intended use, capacity and experience align with the mission and goals of the BLBA.

Along those lines, applicants must demonstrate capacity to complete proposed purchases and projects. Evidence of irresponsible property ownership is also taken into account in evaluating eligibility. Please look through the following questions which will guide the BLBA on initial applicant eligibility.

Failure to stay current on property taxes present a tremendous drain on revenues that support municipal services and our education system. One of the goals of BLBA programming is to return tax delinquent properties to productive use. The BLBA seeks to partner with individuals and entities that not only have the capacity improve the problem properties, but to pay taxes in a timely manner.

Failure to pay sewer/water bills on properties has presented the BLBA and numerous other entities with problems. Liens and other assessments for unpaid utilities often cloud the titles of these properties and hinder them from being put into productive use.

The Alabama Land Bank enabling legislation prohibits the laundering of property taxes, liens/assessments through quiet title and land bank programming for prior owners of tax delinquent property.

The BLBA expends a significant amount of time and resources in processing and clearing title for each successful application. The BLBA reserves the right to bar applicants that have failed to perform under the terms of their executed agreements with the BLBA.

6.1 Transferee Qualifications and Reserve Discretion.

The BLBA reserves full and complete discretion to decline applications and proposed transaction agreements from individuals and entities that meet any of the following
criteria:

  • a. Failure to perform in prior transactions with the BLBA;
  • b. Ownership of properties that became delinquent in ad valorem tax payments and remain delinquent in ad valorem tax payments during their ownership;
  • c. Parties that are barred from transactions with local government entities;
  • d. Parties not able to demonstrate sufficient experience and capacity to perform property maintenance and application for property is in accordance with the requirements of the BLBA;
  • e. Ownership of properties that have any unremediated citation for violation of the state and local codes and ordinances;
  • f. Transferees or family members of transferees who use subject property as his or her personal residence at any time during the twelve (12) months immediately preceding the submission of application (except in rental cases).
  • g. Transferees or family members of transferees who owned subject property during a period of time when subject property became delinquent in ad valorem tax payments.
  • h. If transferees whose application has been approved and who have been contacted to sign agreements or otherwise take action requested by BLBA staff and do not do so within 60 days of contact, BLBA staff will close the application.
